The following document contains the Terms and Conditions for all holdings of Business Expert Solutions Inc., which include Business Expert Solutions, Executive Wins, GordSheppard.com, and Meeting Leadership Inc.

Introduction

Welcome to Executive Wins (https://executivewins.com), Business Expert Solutions (https://businessexpertsolutions.com), GordSheppard.com (https://gordsheppard.com), and Meeting Leadership Inc. (https://meetingleadershipinc.com) — each of which is owned and operated by Business Expert Solutions Inc. This User Agreement governs your use of all of these websites, and any related tools, applications, diagnostics, calculators, or digital products made available on or through them (collectively, the “Resources”).

By visiting any of these websites and/or accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as the “User Agreement”).

This agreement was originally effective as of August 15, 2024, and was last revised on August 11, 2026.

We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of any of our sites or Resources after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.

Responsible Use and Conduct

By visiting our websites and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as “Resources”), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations and generally accepted online practices or guidelines.

Wherein, you understand that:

  1. In order to access our Resources — including any assessment tool, diagnostic, or application described in the “Assessment Tools, Diagnostics, and Applications” section below — you may be required to provide certain information about yourself (such as your name, email address, company name, or responses to assessment questions) as part of a registration, sign-up, or submission process. You agree that any information you provide will always be accurate, correct, and up to date.
  2. You are responsible for maintaining the confidentiality of any login information, private results links, or access links associated with any account or session you use to access our Resources. Accordingly, you are responsible for all activities that occur under your account or access link.
  3. Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.
  4. Engaging in any activity that disrupts or interferes with our Resources, including the servers, databases, and/or networks to which our Resources are located or connected, is strictly prohibited.
  5. Attempting to copy, duplicate, reproduce, sell, trade, or resell our Resources — including any assessment tool, diagnostic report, scoring methodology, or application — is strictly prohibited without our prior written consent.
  6. You are solely responsible for any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.
  7. We may provide various open communication tools on our websites, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. By posting information or otherwise using any open communication tools as mentioned, you agree that you will not upload, post, share, or otherwise distribute any content that:
  8. Is illegal, threatening, defamatory, abusive, harassing, degrading, intimidating, fraudulent, deceptive, invasive, racist, or contains any type of suggestive, inappropriate, or explicit language;
  1. Infringes on any trademark, patent, trade secret, copyright, or other proprietary right of any party;
  2. Contains any type of unauthorized or unsolicited advertising;
  3. Impersonates any person or entity, including any Business Expert Solutions Inc. employees or representatives.

We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.

We do not assume any liability for any content posted by you or any other 3rd party users of our website.

However, any content posted by you using any open communication tools on our website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of Business Expert Solutions Inc., and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of a registration process, or as part of your use of an assessment tool or application, necessary in order to use our Resources.

You agree to indemnify and hold harmless Business Expert Solutions Inc. and its affiliates, and their directors, officers, managers, employees, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account or use incurred by you or any other person using your account or access link. We reserve the right to take over the exclusive defence of any claim for which we are entitled to indemnification under this User Agreement. In such an event, you shall provide us with such cooperation as is reasonably requested by us.

Assessment Tools, Diagnostics, and Applications

Business Expert Solutions Inc. offers a range of interactive web-based tools, including but not limited to the Executive Team Scorecard, team and individual leadership diagnostics, and related self-assessment applications (each, a “Tool,” and collectively, the “Tools”). By using any Tool, you additionally understand and agree that:

  1. Self-reflection, not certification. Each Tool is a self-reflection and informational resource intended to help you and your team think through leadership, execution, and performance topics. No Tool is a certified, clinical, or scientifically validated diagnostic, psychometric, or assessment instrument, and no Tool is a substitute for professional, legal, financial, medical, or psychological advice.
  2. AI-generated content. Some Tools use artificial intelligence (including third-party AI models) to generate narrative commentary, summaries, recommendations, or reports based on the information and responses you provide. AI-generated content may contain errors, omissions, or inaccuracies, is provided for general informational and directional purposes only, and should not be relied upon as the sole basis for any business, personnel, financial, or strategic decision. You are responsible for independently verifying and exercising your own judgment regarding any output generated by a Tool.
  3. No outcome guarantee. We do not guarantee any particular business result, performance improvement, team outcome, or score from your use of any Tool, whether used on its own or in conjunction with any coaching, training, facilitation, or consulting services we provide.
  4. Data you submit. Information you submit through a Tool (such as your name, email address, company name, and your responses to assessment questions) is collected, used, and stored in accordance with our Privacy Policy. If you use a Tool as part of a team or group assessment, you understand that a facilitator, team lead, or organizer for that team may be able to view an anonymized or aggregated comparison of team responses as described within the Tool itself at the time of use.
  5. Free and paid Tools. Some Tools may be offered free of charge, while others may require payment, a subscription, or may be offered as part of a paid coaching, training, or consulting engagement. Where a Tool is offered as part of a paid plan or subscription, the pricing, billing, and cancellation terms presented to you at the time of purchase will apply in addition to this User Agreement. Where a Tool is offered free of charge, the Refund Policy below does not apply to that Tool, as no payment has been collected for its use.
  6. Availability. We may modify, suspend, or discontinue any Tool, in whole or in part, at any time without notice or liability to you.

Limitation of Warranties

By using our website and/or related properties, you understand and agree that all Resources we provide — including all Tools — are “as is” and “as available”. This means that we do not represent or warrant to you that:

  1. the use of our Resources will meet your needs or requirements.
  2. the use of our Resources will be uninterrupted, timely, secure or free from errors.
  • the information, scores, reports, or AI-generated content obtained by using our Resources will be accurate or reliable, and
  1. any defects in the operation or functionality of any Resources we provide will be repaired or corrected.

Furthermore, you understand and agree that:

  1. any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
  2. no information or advice, whether expressed, implied, oral or written, obtained by you from Business Expert Solutions Inc. or through any Resources we provide — including any Tool, diagnostic report, or AI-generated commentary — shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.

Limitation of Liability

In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Business Expert Solutions Inc. will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, including any Tool, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

Refund Policy

We want you to be satisfied with anything that you purchase but we also want you to demonstrate that you have tried your best to implement any product that you have purchased. Business Expert Solutions Inc. offers a 60-day refund period for paid products and services. However, in order to qualify for a refund you must prove that you made your best effort to actually use the product.

In the event that you decide your purchase was not the right decision, within 60 days of buying, contact our support team at info@businessexpertsolutions.com and let us know you’d like a refund by the 60th day. You must include any work you have done with the product with your request for a refund. If you request a refund and do not include the work you have done by the 60th day, you will not be granted a refund.

We will NOT provide refunds after more than 60 days following the date of purchase. After day 60, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless if you complete the program.

Please note: If you opted for a payment plan and you do not request a refund within 60 days, with the required coursework at the time of your refund request, you are required by law to complete the remaining payments of your payment plan.

All refunds are discretionary as determined by Business Expert Solutions Inc. To further clarify, we will not provide refunds after the 60th day from your date of purchase and all payments must be made on a timely basis. If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

This Refund Policy applies to paid products, programs, and services. It does not apply to any Tool offered free of charge, as described in the “Assessment Tools, Diagnostics, and Applications” section above.

All content and materials available across all holdings of Business Expert Solutions Inc. — including Business Expert Solutions (https://businessexpertsolutions.com), Executive Wins (https://executivewins.com), GordSheppard.com (https://gordsheppard.com), and Meeting Leadership Inc. (https://meetingleadershipinc.com) — including but not limited to text, graphics, website names, code, images, logos, assessment methodologies, and Tools, are the intellectual property of Business Expert Solutions Inc., and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on these sites is strictly prohibited, unless specifically authorized by Business Expert Solutions Inc.

Termination of Use

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account, login information, or Tool submission history.

Governing Law

This website is controlled by Business Expert Solutions Inc. from our offices located in the Province of Alberta, Canada. It can be accessed by most countries around the world. As each country has laws that may differ from those of Alberta, by accessing our website, you agree that the statutes and laws of Alberta, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.

Furthermore, any action to enforce this User Agreement shall be brought in the national or provincial courts located in Alberta, Canada. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Guarantee

UNLESS OTHERWISE EXPRESSED, BUSINESS EXPERT SOLUTIONS INC. EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
